    Rear End Collision and Glass

    9is question was answered based upon current rules, regulations & statutes in effect on March 5, 2020
     
    QUESTION

    Have an insured who was rearended. He filed a claim through the other carrier. They are paying for the damage to his bumper, but the collision also caused drivers side window to drop into door. The other carrier is due to wear and tear, but window was working properly before accident. Would they be responsible for at least partial payment of the window fix?

     


    ANSWER

    Irene Morrill:   As the saying goes “but for” that accident …the window worked just fine.

    I’d tell the insured is going to make a consumer complaint with MA DOI …and will fill out small claims court paperwork
